Update: The Court has ruled that Datuk Seri Mohd Shafie Apdal is the rightful Chief Minister of Sabah.

The Kota Kinabalu High Court is expected to make a decision today who will be the rightful Chief Minister of Sabah.

Tan Sri Musa Aman, the former Sabah Chief Minister, had in June filed a summons against the Sabah State Governor, Tun Juhar Mahiruddin and Datuk Seri Mohd Shafie Apdal, relating to the appointment of Chief Minister.

The summons, among others, is to seek a declaration that Musa is the rightful Chief Minister according to the state Constitution and the appointment of Mohd Shafie was illegal.

Musa contends that he is the rightful chief minister through his appointment on May 10, and that the subsequent appointment of his successor, Parti Warisan Sabah’s President, Datuk Seri Mohd Shafie Apdal, is illegal. His lawyers have maintained that the Governor has no power under the Sabah Constitution to dismiss Musa as chief minister, while lawyers for Juhar and Shafie are referencing the legal precedent in a 2009 case, where the removal of the Chief Minister of the state of Perak was made legal when he lost the majority in the state assembly.

Kuching-based High Court judge Datuk Yew Jen Kie is set to make her ruling at 2.30pm today (Nov 7).
